Acceptance of Terms

By accessing and using the DataCyber Kitchen website and services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use our services.

Services Description

DataCyber Kitchen provides culinary services including but not limited to:

• Private chef experiences
• Cooking classes and workshops
• Weekly meal preparation services
• Culinary consultation
• Recipe development

Eligibility

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.

Registration and Account

To access certain features of our services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities that occur under your account

Booking and Payments

Booking Process

All services must be booked through our website or by contacting our team directly. Bookings are subject to availability and confirmation.

Payment Terms

Payments for services must be made in accordance with the following terms:

• A deposit may be required to secure your booking
• Full payment is required before service delivery for most services
• We accept major credit cards, debit cards, and electronic transfers
• All prices are in Canadian dollars (CAD)
• Taxes will be applied as required by law

Cancellation Policy

Cancellations must be made according to the following guidelines:

• 48 hours notice required for full refund of deposits
• Cancellations within 24 hours may be subject to a 50% charge
• Same-day cancellations may be charged the full service fee
• We reserve the right to cancel services due to unforeseen circumstances with full refund

User Conduct

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false or misleading information
• Transmit any viruses or malicious code
• Interfere with or disrupt our services
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users or our staff

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of DataCyber Kitchen or our content suppliers and protected by copyright and intellectual property laws. Our recipes, cooking techniques, and culinary methods are proprietary and may not be reproduced without permission.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, DataCyber Kitchen shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

Indemnification

You agree to indemnify and hold harmless DataCyber Kitchen and its affiliates, officers, agents, and employees from any claim or demand made by any third party due to or arising out of your use of our services, violation of these terms, or infringement of any intellectual property rights.

Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting the new terms on our website. Your continued use of our services after such changes constitutes acceptance of the modified terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Dispute Resolution

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in Toronto, Ontario, in accordance with the Arbitration Act of Ontario.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
